I am looking to rewrite my 6 page service contract so the entire contract is reasonable and enforceable.
I provide job search services to job seekers by writing their resume, searching and applying for their jobs, and emailing recruiters. My job is to get them interviews and their job is to pass the interviews. I do not prepare for interviews. Once they get a job, I charge them 5% of their first year's salary. If I do not get them a job, then I charge for the interviews I got them.
My clients are job seekers (I do not work with, talk to, or have any relationship with employers) so the contract should be in easy to understand conversational language. The contract needs to be worded so that the fees are reasonable and charging a fee for finding the job or interviews would be enforceable.
The contract may have loopholes that needs to be identified and resolved in writing. For example, in some worst case scenarios, the job seekers may not inform me that they found a job or interviews by ignoring my messages or lying to me about how the job or interview was found so the contract would need to include content to help reduce the risk of this issue. The contract should be tailored for my business model for a sole proprietorship based in San Jose, California. The contract should apply to international students and US Citizens.
